Suomen IPR-strategia – Missä mennään?

Vuonna 2022 tehtiin valtioneuvoston periaatepäätös kansallisesta IPR-strategiasta, jonka tarkoitus on kehittää suomalaisten toimijoiden IPR-osaamista ja luoda Suomeen toimiva ja kilpailukykyinen IPR-järjestelmä. Strategian tavoitteena onkin, että Suomessa olisi vuonna 2030 tehokkaasti innovaatiotoimintaa ja luovaa työtä tukeva IPR-toimintaympäristö, joka kasvattaa taloudellista hyvinvointia ja kilpailukykyä siten, että perusoikeuksien toteutuminen ja eri yhteiskunnalliset intressit otetaan monipuolisesti huomioon.  Näiden tavoitteiden toteuttamiseksi valtioneuvoston periaatepäätöksessä on ehdotettu 15 konkreettista toimenpidettä.

Suomen IPR-Strategia on Työ- ja elinkeinoministeriön hanke, mutta strategiaa toimeenpanee usea ministeriö. Kansallisen aineettomien oikeuksien strategian virkamiesohjausryhmässä toimivat ohjausryhmän puheenjohtaja teollisuusneuvos Maija Lönnqvist, sekä johtava asiantuntija Harri Länsipuro työ- ja elinkeinoministeriön (TEM) innovaatiopolitiikka-ryhmästä. Lönnqvist on myös innovaatiopolitiikka-ryhmän johtaja.

Virkamiesohjausryhmä kokoontuu tietyin väliajoin tarkastelemaan IPR-strategian toimeenpanon edistymistä. Tässä artikkelissa Lönnqvist ja Länsipuro kertovat, miten strategian toimenpiteet ovat edistyneet. Esimerkiksi strategiassa mainitut lainsäädäntöhankkeet, selvitykset, Opetus- ja kulttuuriministeriön (OKM) tekijänoikeushankeet sekä IPR University Centerin rahoitushanke ovat edenneet.

Patenttilainsäädännön kokonaisuudistus

Osana aineettomien oikeuksien strategian toimeenpanoa on toteuttaa patenttilainsäädännön kokonaisuudistus. Lönnqvist kertoo olevansa tyytyväinen, että patenttilakia on päästy vihdoin uudistamaan ja, että uudistaminen on edennyt hyvin. Hankkeessa valmistellaan tällä hetkellä hallituksen esitystä, joka on tarkoitus lähettää Lönnqvistin mukaan mahdollisesti lausuntokierrokselle keväällä 2025. Lönnqvist kertoo uudistamisen olevan suurelta osin lain ”siivousoperaatio”, sillä laki on vanha, monikerroksinen ja monimutkainen. Hän kertoo patenttilainsäädännön olevan jopa niin kerroksellinen, että osa palasista vaatii muutoksia ollakseen perustuslain mukaisia.

19.9.2024 sulkeutui lausuntokierros arviomuistiosta hyödyllisyysmallilaista. Arviomuistiossa kiinnitettiin huomiota hyödyllisyysmallilain muutostarpeisiin.

Arviomuistiossa huomautettiin, että hyödyllisyysmallijärjestelmällä on selvitysten valossa enemmänkin negatiivinen vaikutus innovaatiotoimintaan ja kilpailuun, samalla moni sidosryhmä myös puolustaa sitä. Arviomuistiossa myös mainittiin mahdollisia keinoja kehittää järjestelmää esimerkiksi keksinnöllisyyden tason nosto, englanninkielinen hakemus, armonajan lisääminen eli uutuusvaatimuksen alentaminen. Lönnqvist ja Länsipuro kertoivat, että haastatteluhetkellä päätöstä TEM:in suosituksesta hyödyllisyysmallioikeuden jatkosta ei ole vielä tehty.

PK-yritykset ja IPR-strategia

Periaatepäätöksessä ehdotetuissa toimenpiteissä mainitaan pienille- ja keskisuurille yrityksille (PK-yrityksille) suunnatun IP-neuvonnan ja tiedonsaannin lisääminen. Osana tätä toimenpidettä oli suunniteltu PK-yrityksille suunnattu IPR-kummi-järjestely.  Länsipuro kertoo, että valitettavasti suunniteltu IPR-kummitoiminta ei ole ottanut vielä tulta alleen, mutta sitäkin on edistetty. IPR-kummitoiminnan tarkoitus olisi luoda lähestyttävä ja yksittäisen yrityksen ja henkilön tarpeet huomioiva, sparraava järjestely vastaamaan PK-yritysten toiveita. Tavoite on lisätä tietoa ja neuvontaa yrityksen koko IP-potentiaalin tunnistamiseen. Länsipuro kertookin PK-yritysten osaamisen kasvattamisen olevan haastavin strategian toimenpiteistä toteuttaa.

– Olisi hienoa, jos jokaisella Suomen PK-yrityksellä olisi oma IPR-strategia. Erityisesti tutkimus ja kehitystoimintaa tekevien PK-yritysten kohdalla tämä olisi olennaista, Länsipuro toteaa.

Myös Lönnqvist korostaa haasteena sitä, ettei PK-yritysten IPR-osaaminen ole vielä toivotulla tasolla.

– Jotta uutta liiketoimintaa voidaan luoda, on olennaista, että yritykset osaavat suojata innovaatioitaan oikealla tavalla sekä tarvittaessa puolustaa oikeuksiaan. Osaamispulaa ei tulisi nähdä pelkästään valtioneuvoston tai hallinnon asiana, vaan haaste kohdistuu koko IPR-kentälle ja sitä tulisi yhdessä ratkoa, Lönnqvist kertoo.

Lönnqvist huomauttaa, että valtio investoi paljon tutkimus- ja kehitystoimintaan (T&K) ja siten aktivoi yrityksiä lisäämään kokonaisvaltaisemmin myös TKI-toimintaansa. Hän myös muistuttaa, että jos näistä tutkimus- ja kehitystoimintaan tehdyistä investoinneista halutaan saada hyöty, on osattava hyödyntää strategisesti aineettomia oikeuksia.

IPR University Centerin rooli IPR-osaamisen vahvistajana

Yhtenä toimenpiteenä strategiaan kuuluu IPR University Centerin roolin vahvistaminen yleisen IPR-koulutuksen ja IPR-asiantuntijoiden täydennyskoulutuksen tarjoajana. Tavoitteiksi asetettiin periaatepäätöksessä, että koulutusten tarjonnan tulisi olla entistä laajempaa ja sopia eri sektoreiden tarpeisiin. Uutta koulutusta ja sisältöjä tulisi jatkossa tuottaa myös Start up -yrityksille. Kokonaisuudessaan IPR University Centerin tarkoitus on lisätä IPR-osaamista yrityssektorilla, tuomioistuinlaitoksessa ja viranomaisissa.

Myös Länsipuro ja Lönnqvist korostavat IPR University Centerin tärkeää roolia, sillä instituutti linkittyy vahvasti IPR-osaamisen edistämiseen.

– IPR University Centerin rahoitus on edennyt osana IPR-strategiaa ja tämän avulla voidaan tarjota kaikille avoinna olevaa koulutustarjontaa immateriaalioikeuksista ja niiden hyödyntämisestä, Länsipuro kertoo.

IPR University Center on aloittanut toimet tavoitteen saavuttamiseksi ja nämä toimenpiteet on jaettu kahteen osa-alueeseen: koulutussisältöjen kehittämiseen sekä Business Loves IPR -työpajoihin. Koulutusten osalta tarkoitus on luoda täysin uusia verkkokursseja sekä uudistaa jo olemassa olevia. IPR University Centerin IPR is the new black- kurssi uudistetaan vastaamaan alan muutoksia, kuten DSM-direktiivin (tekijänoikeusdirektiivi) täytäntöönpanoa ja yhdistetyn patenttituomioistuinjärjestelmän toiminnan alkamista. Uusia kursseja on tulossa liittyen EU:n uuteen data sääntelyyn sekä PK-yrityksille suunnattu aineettomien oikeuksien kurssi. Business Loves IPR -työpajat ovat verkossa toteutettuja kaikille avoimia tilaisuuksia, jotka ovat erityisesti suunnattu PK- ja kasvuyrityksille. Tilaisuuksissa on puhumassa IPR-alan ammattilaisia Suomesta ja ulkomailta ja osallistujilla on mahdollisuus käydä keskustelua ja esittää kysymyksiä asiantuntijoille.

– Minulla on suuret odotukset IPR University Centerin koulutustarjonnan laajentamisesta. Tärkeää on kuitenkin myös huomioida, että koulutus saadaan hyötykäyttöön. IPR-kentän aktivoimiseksi ratkaisuja voisi löytyä myös eri edunvalvontajärjestöjen kautta, toteaa Länsipuro.

Strategia luo pohjan

Periaatepäätös strategiasta oli ensimmäinen askel kohti vuoden 2030-tavoitetilaa, jota kohti jo edetään haasteista huolimatta. Kuten Max Oker-Blom totesi artikkelissa Ehdotus kansalliseksi IPR-strategiaksi (IPRinfo 3/202116.6.2021), aineettoman omaisuuden ja aineettomien oikeuksien merkitystä tämän päivän yhteiskunnassa ei ole syytä aliarvioida.

Kumpikin Lönnqvist ja Länsipuro korostivat läpi haastattelun, että valtion hallinto voi luoda toimivan IPR-järjestelmän, mutta on eri toimijoiden tehtävä hyödyntää IPR-suojaa toiminnassaan.

– Haasteena ei ole, että Suomi ei osaisi insinöörikansana innovoida, kehittää uutta teknologiaa. Haasteena on osaamisen hyödyntäminen. Lisäksi on mietittävä, mikä olisi suojaamisen taktinen ja strateginen rooli, Länsipuro kommentoi.

– Uusien innovaatioiden kautta voimme löytää ratkaisuja erilaisiin haasteisiin, kuten talouden ongelmiin, ilmastonmuutokseen, luontokatoon, ikääntymiseen, terveyshaasteisiin ja tuloskasvuun. Tämän onnistumiseksi meidän on kuitenkin opittava suojaamaan ja hyödyntämään IPR:iä, Lönnqvist tiivistää.

Translation: The Current Status of the Finnish IPR Strategy  

In 2022 Finland adopted a resolution on a national IPR strategy. The aim of the strategy is to increase the IPR expertise of Finnish organisations, and to have an effective IPR system in Finland that supports innovation and creative work. This, in turn, should increase Finland’s economic well-being and competitiveness, taking into account fundamental rights and different societal interests. To achieve these goals the resolution lists 15 actions to be taken. 

The IPR strategy is steered by the Ministry of Economic Affairs and Employment (TEM), but it is carried out through collaboration between several ministries. Senior Ministerial Adviser Maija Lönnqvist and Specialist Harri Länsipuro are part of the Ministerial Steering Group responsible for this strategy going forward and they both work on the strategys implementation on a daily basis in TEM’s Innovation Policy Unit. Lönnqvist is also the director of the Innovation Policy Unit of TEM. 

The Ministerial Steering Group meets regularly to review the progress in the implementation of the IPR strategy. In this article Lönnqvist and Länsipuro update us on the strategy’s progress. Lönnqvist and Länsipuro emphasize that, for example, the legislative projects, reports, the Ministry of Education and Culture’s (OKM) copyright initiatives and the IPR University Centers funding projects have made progress. 

The full reform of the Finnish patent law 

As part of the implementation of the IPR strategy, a comprehensive reform of patent law will be carried out. Lönnqvist reports being pleased with the fact that Finland has finally been able to begin updating its old patent law. She also notes that the reform has been progressing well. A government proposal is currently being prepared, and it is scheduled to be published for consultation in the spring of 2025. Lönnqvist notes that the reform is mainly a “cleaning and clearing out” -operation because the patent law is old, multi-layered and complicated. Some parts need to be revised to make sure they are in line with the Finnish Constitution, she says. 

On the 19th of September the consultation period for the assessment report on the utility model ended. The assessment report focused on the possible need for changes in the laws governing the utility model. 

The assessment report pointed out that according to surveys the utility model system has had a negative impact on innovation and competition. On the other hand, it is defended by several stakeholders. The report also mentioned possible ways to improve the system for example, by raising the required level of inventiveness, adding an option for an English application, adding a “grace period” by lowering or weakening the required level of novelty. Lönnqvist and Länsipuro say that at the time of the interview their Ministry had not made an official statement on the utility model, so they are unable to comment on the future of the utility model in Finland. 

SME’s ja IPR Strategy 

One of the measures proposed in the IPR strategy is to improve access to IP advice and information for small and medium-sized enterprises (SMEs). One of the measures envisaged to achieve this objective was the establishment of an IPR tutoring scheme. (The word-to-word translation is IPR-godmother scheme.) This scheme has not yet been put into practice according to Länsipuro. However, the first steps have been taken, he adds. The aim of the IPR tutoring scheme would be to create an accessible scheme tailored to the needs of companies and individuals. It would be molded to meet the wishes of especially SMEs. The aim of the scheme is to provide more information and advice in order to identify a company’s full IP potential. Länsipuro confirms the importance of this scheme by stressing that increasing the IPR know-how of SMEs is the most difficult goal of the IPR strategy to carry out. 

– It would be great if all Finnish SMEs had their own IPR strategy. This is especially critical for SMEs that invest in research and development, Länsipuro emphasizes. 

Lönnqvist also points out that one of Finland’s challenges is that the IPR expertise of Finnish SMEs is not yet at the desired level. 

– In order to create new business, it is essential that companies know how to protect their innovations in the right way and to defend their rights when necessary. The skills shortage should however not be seen only as a problem for the government and administration to solve alone. It should be seen as a challenge for the whole IPR field, which should be tackled together, Lönnqvist explains. 

Lönnqvist points out that Finland invests heavily in research and development (R&D) and in this way it hopes to encourage companies to invest in their own research, development and innovation (RDI). She also reminds that, if a company wishes to extract value from those investments, it must be able to use intellectual property strategically. 

IPR University Centers role in strangthening IPR expertise  

One of the measures introduced in the strategy is to strengthen the role of IPR University Center as a provider of accessible and public IPR training and further training for IPR specialists. The objectives set out in the strategy were that training should be more widely available and adapted to the needs of different sectors. New training and content should also be provided specifically for start-ups in the future. The overall aim of IPR University Center is to increase IPR expertise in the business sector, the judiciary and public authorities. 

Länsipuro and Lönnqvist also highlight the important role of the IPR University Center through its work in improving and promoting IPR understanding. 

– The funding project for IPR University Center has been forging on within the Ministry. With this we aim to offer publicly available resources for education on intellectual property and how to utilize them strategically for everyone, Länsipuro explains. 

The IPR University Center has started to work towards this goal and these measures are divided into two parts: the development of training/education content and the Business Loves IPR workshops. In terms of training, the aim is to create entirely new online courses and update existing ones. The IPR University Center’s IPR is the new black -course will be updated to reflect changes in the sector, such as the implementation of the DSM (Copyright Directive) and the emergence of the Unified Patent Court system. New courses will be added. One of these new courses will cover the new EU data regulation and another will be an IPR course specifically for SMEs. The Business Loves IPR -workshops are online events open to all but specifically targeted at SMEs and growth companies. The speakers at these events will be IP experts from Finland and abroad, and participants will have the opportunity to discuss and ask questions from the experts. 

– I have high expectations for IPR University Center updating and expanding its training and education catalogue. However, it is important to think about how we can utilize this knowledge and how do we get people to use it. One way to get the knowledge out could be found through organizations that advocate for different groups, Länsipuro adds.   

The Strategy is the first step 

This strategy is only the first step towards the goal for year 2030. Although there are difficulties along the way, the implementation is moving forward. As Max Oker-Blom remarked in “Ehdotus kansalliseksi IPR-strategiaksi (IPRinfo 3/2021 16.6.2021), the role of intellectual property and intellectual property rights in modern society should not be underestimated. 

Both Lönnqvist and Länsipuro emphasized through their interview that the government can create a functioning IP System, but it is the up to each actor themselves to make use of it. 

– The difficulty isn’t that Finland, as a country full of engineers, could not innovate and create new technologies. Rather, the difficulty lies in utilizing this expertise. Additionally, we must think about the strategic role of the protection of intellectual property, Länsipuro comments. 

– Through innovation we can find solutions to various problems such as economic and financial issues, climate change, loss of biodiversity, ageing society, health problems etc. In order to be successful, however, we must learn to protect and take advantage of intellectual property rights, concludes Lönnqvist.
