In Ukraine computer generated works registered under sui generis right
The Ukrainian IP office announced that works have been registered under a new sui generis right for computer generated works. These works include a collection of easter cards, a children’s book and a collection of poems.
The collection of easter cards was generated by a computer program and compiled by a human. The book and the collection of poems were on the other hand illustrated with AI generated images. In relation to this the Ukrainian IP office reminded that in Ukraine copyright protects only works created by humans.
Through a new copyright law adopted in 2022 a new type of sui generis right was created in Ukraine. This right is in force for 25 years after the creation of the work. The time is calculated from January 1st of the following year of when this work was created. The owner of this right can be the author of the computer program or their heirs; lawful users of the computer program; owners of the economic rights of the program; or those who have licensing powers to the computer program.
